N’est stupide que la stupidité


Je ne peux travailler avec des associations radicalement radicaux. Qui ont une vue sur la justice non objective, non ce n’est pas moi mais c’est la faute à sarko au bout de 5 ans de mandat il doit être bossus. Des associations qui ne proposent pas mais qui dénoncent toutes les cinq minute sans vraiment maitrisé les sujets et qui ont un point de vue fermer.

Une Passerelle entre le 18 mai 2010 et le 10 mars 2012.



Samedi 10 mars 2012, la rencontre.

Après 653 jours de séparation totale, la rencontre a bien eu lieu. Pour le plus grand bonheur et la plus grande joie de chacun. Un des plus beaux et des plus intenses jours de ma vie.

Dans l'attente des conclusions des procédures en cours, j'interromps ce blog, pour une relative sérénité et un apaisement nécessaire au renouement.

Bien évidemment, la lutte continue jusqu'à ce que la justice soit rendue, et jusqu'au rétablissement d'un mode équitable de résidence alternée.

Mes fidèles anonymes peuvent me rejoindre sur Facebook (lepapadenina Grenoble) ou Netlog (lepapadenina): réseaux sociaux confidentiels, sélectifs, plus adaptés à la situation actuelle.

Mes remerciements chaleureux à mes alliés de la première heure et aux autres.

Je ne citerai qu'une phrase de ma fille; sa première phrase suite à 15 minutes d'observation et de mutisme. Après l'avoir rassurée, je lui exprimais mon tract, ma crainte qu'elle m'ait oublié. A quoi elle a répondu, étonnée, me regardant droit dans les yeux, plein d'aplomb:



"Comment tu as pu penser une chose pareille!"





J'ai entendu le mot "papa", mot que j'attends depuis près de deux ans...

Merci ma fille de te battre avec tant de force, au milieu des conflits des adultes. A demain, mercredi.

Stéphane made a one-week hunger strike on the place of the Hotel-de-Ville. He and his wife Myriam say they are victims of a relentless and harassment threatened to see the children of Myriam be removed and placed in foster care. Originally from Narbonne, Myriam has everything to be happy. And yet others decided otherwise. Some years ago, she was living in Carcassonne with her first husband with whom she had two children. "He was drinking, was violent. "he was sentenced for this," she said. She requested the divorce in 2003. Her former husband is not. She gets divorce in 2006. Myriam worked in the medium of childhood, in the animation, and then as an educator teaching in Béziers.



After the divorce began another. She have been the victim of harassment by her former husband, but the administration also. "My ex-husband is known here, there a lot of relations," she continues. "One day, social services went to school in Carcassonne search my children." I have not reviewed them for a month. I did not know where they were. I had no news. Their father had relied on the fact that I have him to see. "This is false".



This same father who complained to not see her children therefore retrieves them and to the DDASS met…. In 2007, she retrieves her children, met Stéphane. They remake their lives and decide to marry. They move, change region for professional reasons, but her former husband began several judicial procedures with each time of psychological tests to Myriam and her children. They show no abnormalities. Myriam and Stéphane face huge costs to defend himself, to the point of being ruined. Today, Myriam is again threatened, you want to take her children to place them in a foster home. They are tipped. They would simply like to live a normal family life.

Cette partie a son importance, car elle montre que les enfants ont une relation primaire, une relation d'amour avec leurs parents. De ce fait, notre présence dans le cercle familial n'est pas toujours bien vécue, que ce soit de la part des parents ou des enfants. Je vais tenter de vous expliquer la relation que peut avoir un enfant avec ses parents ce qui nous permettra d'appréhender ne serait-ce qu'un minimum la souffrance de la famille face au placement et surtout pourquoi il est important de travailler en collaboration avec les parents : Pour ne pas casser le lien familial.

Je différencie la relation avec le père et la relation avec la mère car je pense qu'elles apportent des éléments différents à l'enfant, mais qu'il a besoin de ces deux échanges. Car les parents sont complémentaires. Chacun apporte un plus à l'enfant.

L'ENFANT ET LE PÈRE
Qu'entendons-nous par le mot père. Nous allons voir qu'il peut-être vu de différentes manières.

Cependant je pense que le statut de père ne tient pas en une définition mais bien dans la façon dont ce dernier prend son rôle, que ce soit dans une famille traditionnelle, recomposée ou monoparentale.

On pourrait d'abord définir plus précisément « qui est le père » ? Pour cela, voyons quelques chiffres. En effet, selon Henri Leridon et Catherine Villeneuve Gokalp,7(*) démographes à l'INED, il y a de plus en plus d'unions libres au détriment du nombre de mariages qui diminuent.

- Le nombre de mariage (en milliers) 269 en 1985, 287 en 1990 et 255 en 1995.

- Le nombre de divorces en milliers : 110,4 en 1985 ; 108,8 en 1990 ; 124 en 1995.

- Naissances hors mariage (pour 100 naissances) : 19,6 en 1985 ; 30,1 en 1990 ; 37,6 en 1995

Ces démographes notent également une forte hausse des divorces. Actuellement, cet effondrement du mariage a une conséquence sur les formes de famille. En effet, le modèle nucléaire c'est-à-dire les parents unis par le mariage et les enfants issus de cette union vivant sous le même toit s'effiloche pour laisser la place aux unions libres et aux enfants naturels c'est-à-dire issus de parents non mariés. Dans les recompositions familiales, le père « géniteur » n'est pas forcément le même homme que le père légal, qui n'est pas forcément non plus le père qui assure l'éducation de l'enfant.

Selon Irène Théry8(*), sociologue et juriste, les enfants peuvent avoir plusieurs pères : des pères légaux et des pères de faits.

Je ne suis pas d'accord avec cela. Pour moi, un enfant n'a qu'un seul père. Les autres sont des substituts. Il existe cependant des modèles familiaux différents :

La famille traditionnelle : également appelée modèle nucléaire. Les parents sont unis par le mariage, les enfants sont issus de cette union et vivent ensemble sous le même toit.

La famille recomposée : se désigne pour les familles dont les parents ont eu des enfants d'une précédente union. Par exemple, Martine, divorcée, a 2 filles. Et Paul, divorcé aussi, a 1 fille et 1 garçon. C'est une famille recomposée, Paul n'est pas le père des filles de Martine, et Martine n'est pas la mère des enfants de Paul. Mais ils vivent ensemble, sous le même toit. Il y a la notion de beau-père ou de belle-mère.

La famille monoparentale : se caractérise par le fait qu'un seul parent vit avec ses enfants. L'autre parent peut soit être décédé(e), soit avoir quitté la maison (divorce).

Benoît, Mathias et Magali sont frères et soeurs. Ils ont été placés par le juge pour violences familiales (lors d'une dispute, la plus jeune à été hospitalisée). Le père est alors emprisonné. La maman se retrouve seule avec ses 8 enfants, il y a eu des carences affectives et alimentaires. Pendant le placement, le père décède.

Les rares week-ends où les enfants rentrent chez eux, la maman leur présente un nouveau compagnon et leur dit : « C'est votre nouveau papa. » Les enfants sont perturbés, ils se sentent perdus et abandonnés par leur mère qui ne leur montre jamais un signe d'amour. Cependant ils acceptent sans difficulté leur nouveau papa, et rentrent au foyer tous joyeux d'avoir un papa !

J'explique alors aux trois enfants que ce n'est pas leur papa. Que leur vrai papa est décédé, et que l'homme qui vit aujourd'hui avec leur maman est son nouveau compagnon, donc leur beau-père. Mais il ne remplace pas leur papa. Même si dorénavant, c'est le chef de famille, et qu'il faudra lui obéir. Mon but est de leur faire comprendre qu'on a un seul papa.

Benoît, Mathias et Magali ont vraiment beaucoup de mal à entendre et à comprendre ce qu'on leur dit, puisque c'est leur maman qui le leur a dit, et qu'ils doivent l'appeler papa. A moi, de leur expliquer que même s'ils l'appellent papa, il ne va pas remplacer le vrai papa dans leurs coeurs.

Nous voyons bien que la définition du père peut être difficile pour un enfant. Dans cette situation, ce qui a perturbé les enfants c'est que les éducateurs n'avaient pas le même discours que la mère concernant leur papa. Pour moi, les enfants devaient garder en mémoire leur papa décédé. Et pour la maman, qui reconstruisait sa vie avec un nouveau compagnon, elle voulait effacer de sa vie l'ex-mari violent et redonner une place de père à ce nouvel ami.

L'enfant n'a qu'un père, et c'est important qu'il le sache. Néanmoins, il y a des enfants qui n'ont pas connu leur vrai père, seulement un substitut de père. Et pour ces enfants là, si on leur pose la question : qui est ton père ? Je suis sûr qu'ils répondront le substitut. Car c'est le seul qu'ils aient connu, même si au fond d'eux-mêmes, ils savent que leur vrai père est décédé dès leur naissance. Ils sont conscients que l'homme qui les a élevés n'est pas leur père géniteur mais ils l'assimilent comme tel. Car c'est lui qui les a aimés, nourris, aidés, soutenus, encouragés... A ce niveau là, il y a les sentiments qui interviennent.

Le substitut peut parfois mieux remplir son rôle de père que le géniteur.

Selon moi, le père ne se définit pas biologiquement ou même légalement. Ce n'est pas un statut que l'on possède mais un rôle que l'on tient, que l'on revendique et que l'on assume auprès de l'enfant. « On devient père avec sa tête tout autant qu'avec son coeur et son corps » Jean Le Camus.9(*)

Le point de vue des professionnels :

A ce sujet, Jean Le Camus, psychologue spécialiste dans le développement de l'enfant dit : « en tant que représentant de la loi et incarnation du lien social, le père aide l'enfant à s'ouvrir au monde des autres, à acquérir le pouvoir de contrôle et le désir d'affirmation positive de soi »10(*).

Selon Donald Winnicott, « Il dépend de la mère que le père en vienne ou non à connaître son bébé »11(*) cela laisse penser que le père doit être introduit auprès de l'enfant par la mère.

Aldo Naouri, lorsqu'il parle du père, insiste sur la place que la mère fait à ce père. « Ce qui fait un père, ce n'est pas le fait qu'il y ait un homme présent à côté de la mère. C'est que cette mère reconnaisse cet homme comme père, c'est-à-dire qu'elle lui accorde le droit de limiter sa toute-puissance maternelle, de jouer son rôle de séparateur. »12(*)

Sur ce point-ci, D. Winnicott et A. Naouri se rejoignent assez, tous deux pensent que c'est la mère qui donne une place au père. Personnellement je pense qu'un père présent physiquement dès le début de la vie de son enfant a déjà son rôle, et ce n'est pas la mère qui lui donne puisqu'il le possède déjà. Même si l'enfant ne s'en apercevra que plus tard puisque nous allons voir que l'enfant et sa mère ne forment qu'une entité surtout dans les premiers mois de la vie de bébé.

LE RÔLE DU PÈRE
L'enfant est un avec sa mère même quand le cordon est coupé. Le rôle du père est capital, c'est l'autre par rapport à la mère. Pour l'enfant, le père représente l'autre, devant lequel il va se situer. Papa, c'est l'autorité, la sécurité, la tendresse aussi.

Le rôle du père dans le foyer est primordial. Il joue le rôle de chef de famille. La relation du père à l'enfant ne commence qu'à la naissance ; avant la naissance, la relation est exclusivement maternelle.

On a longtemps pensé que seule la mère était indispensable au bon développement de l'enfant. On sait maintenant que le rôle du père est loin d'être secondaire... au-delà de la figure d'autorité traditionnelle, il exerce une influence positive sur l'ensemble de la personnalité de l'enfant, et ceci dès son plus jeune âge.

La psychologie du XXe siècle s'est accordée à attribuer essentiellement au père la fonction de représentant de la Loi : c'est lui qui, par le fait de son existence empêche symboliquement la relation fusionnelle mère-nourrisson. Cela permet ainsi à l'enfant de s'ouvrir au monde des autres. Le père incarne et transmet à l'enfant les règles qui lui permettront d'acquérir force de caractère, pouvoir de contrôle, sens moral et désir d'affirmation positive de soi. La figure traditionnelle du père se situe donc du côté de l'autorité et il joue un rôle dans la socialisation.

Un des rôles importants du père est la fonction de séparation. Il est là pour dire à l'enfant que c'est un être à part entière. Il permet à l'enfant de ne pas rester le petit objet de sa mère ; le père vient couper le cordon. Cela permet en même temps de dire à la mère qu'elle n'est pas que mère, mais aussi femme et amante. Le père prend sa place dans la relation.

Un modèle d'identification ?

Il est également établi que le père joue un rôle important dans la construction de l'identité sexuelle de l'enfant. Pour le garçon, il est un modèle d'identification : celui à qui il va chercher à ressembler. Pour la fille, il est une sorte de modèle idéal de l'autre sexe : celui qu'elle cherchera à retrouver après la puberté.

On dit souvent que les femmes recherchent leur père dans leur amant...

Dans cette perspective classique, c'est à la mère d'apporter à l'enfant en bas âge affection et présence active; La fonction qui est attribuée au père est symbolique et sa présence effective n'est pas considérée comme indispensable au tout jeune enfant. Ce qui importe, c'est que le père existe dans la pensée et la parole de la mère, indiquant ainsi au petit qu'il n'est pas l'unique objet de son désir. Mais nous allons voir que ce modèle traditionnel est en train de changer.

Les temps ont changé ?

Le rôle traditionnel accordé au père est lié à une conception schématique et dépassée du couple : à l'homme, le monde extérieur et la fonction économique ; à la femme le foyer et la fonction affective. Il est également lié à un modèle de structure familiale construite pour durer.

Or le couple a évolué. Les femmes ont investi le monde du travail et les pères ont tendance à s'impliquer davantage auprès du jeune enfant, dans les jeux, mais aussi dans la vie quotidienne, les repas, les bains... La structure familiale a éclaté pour faire place à une mosaïque de structures différentes (monoparentale, familles recomposées...). Enfin, la vision des rapports au sein de la famille a changé ! La femme n'accepte plus d'être réduite à la maternité. Les hommes sont de plus en plus enclins à renoncer au principe de la puissance paternelle. Ils sont prêts à se reconnaître sensibles, affectueux envers leurs tout jeunes enfants, sans que cela porte atteinte à leur identité masculine. C'est comme si il y avait une ère du « nouveau père » qui arrive.

Qu'apportent les « nouveaux pères » à leurs enfants ?

Plusieurs études récentes ont été menées sur l'influence de la présence physique et active des pères auprès des tout-petits. Elles ont montré que cette présence les prépare plus efficacement et plus rapidement que ne le ferait la mère à s'aventurer dans le monde extérieur. Ils seraient plus vite à même de se débrouiller tout seul, de se faire reconnaître et accepter dans un groupe d'enfants et d'intégrer les règles de la vie collective.

Par ses taquineries, ses tentatives de déstabilisation, le père incite l'enfant à s'adapter à la nouveauté.

Par sa tendance à encourager l'exploration, il le prépare à affronter l'inconnu.

Par son inclination pour les jeux physiques (chatouilles, luttes simulées...), il contribue à le sensibiliser au respect des règles et de l'adversaire.

En effet, qui n'a jamais joué à se battre avec son propre père ? Personnellement étant enfant, je me souviens que j'adorais jouer à ça avec mon père, j'adorais quand il me chatouillait et que je le suppliais d'arrêter tellement je riais...Je me souviens de ces fameux jeux de bagarre où ma mère s'énervait sur mon père en lui disant « arrête de l'énerver ! » Ses plaisanteries qui font que nous partions bouder dans notre coin pour revenir à la charge cinq minutes plus tard ! Je suis sûre que beaucoup d'enfants ont ce souvenir avec leur papa.

Les pères exercent donc une action dynamisante dès les premières années de la vie de l'enfant, en l'aidant à faire le pont entre l'affirmation de soi dans la famille et l'affirmation de soi à l'extérieur.

Un rôle affectif aussi fort que celui de la mère ?

Un domaine des relations père-enfant que les études n'ont pas encore exploré reste celui de la forme que peut prendre leur attachement affectif, domaine traditionnellement réservé à la mère. Il a toutefois été prouvé (assez récemment) que l'enfant de moins de 1 an était susceptible de s'attacher à plusieurs personnes, et donc à son père. Toutefois, si l'enfant est en situation de détresse, la mère reste la plus à même de le réconforter.

In October 2001, the Court adopted its first statements of procedure for the use of the States appearing before it. Procedure instructions result in no change to the regulations of the Court, but added to that‑above. They are the result of constant review by the Court, of its methods of work. Once adopted by the Court, any changes to procedure instructions is now placed on the Court's Internet site and published in the Yearbook of the Court, with mention, where appropriate, of any reserve ratione temporis on its applicability.

Statement of procedure I

The court wishes to discourage the practice of simultaneous filing of procedural documents in the cases by way of compromise.



The Court expects that the compromise which will be concluded in the future will include provisions as to the number and the order of presentation of procedural documents, article 46, paragraph 1. These provisions shall prejudice any questions which may arise in the case, including that of the burden of proof.



If the compromise contains no provision as to the number and the order of procedural documents, the Court expected to what the parties are agreed on this point, article 46, paragraph 2.



Statement of procedure II

Each of the parties, in the preparation of each piece of procedure, must bear in mind the fact that‑here is not only to respond to the findings and means of the opposing party, but still and especially to present clearly the findings and means of its author.



However, each party must be included in the conclusion of his procedure plays a brief summary of his argument.



Statement of procedure III

The parties are very urged to ensure that their entries are as concise as possible, within limits compatible with a comprehensive presentation of their positions.



In the light of an excessive trend to the proliferation and elongation of annexes to procedural documents, parties are also urged to operate a rigorous selection of the documents that they attach.



Statement of procedure IV

When one or other of the parties has in whole or in part, a translation of his pieces of procedure or those of the opposing party in the other official language of the Court, it goes without saying that these translations must be provided at the registry of the Court. It is the same for the annexes.



The registry will review these translations and transmit them to the opposing party by him specifying the conditions under which they were established.



Procedure training V

To speed up the proceedings on preliminary objections raised by a party under article 79, paragraph 1, of the regulations of the Court, the time limit for the presentation by the other party of a statement written containing its observations and conclusions, within the meaning of section 79, paragraph 5, shall generally not exceed four months from the date of submission of the said preliminary objections.



Statement of procedure VI

With respect to the pleadings, the Court requests full respect of article 60, paragraph 1, of its rules, as the degree of brevity required. In this context, the Court would be very useful that the parties prefer, in the first round of the oral procedure, the points that were raised by one of them at the stage of the written procedure but have not yet been processed properly by the other, and those on which they take to focus to conclude their arguments. Review of exceptions of incompetence or estoppel, the oral procedure must be confined to presentations on the exceptions.



Statement of procedure VII [**]

The Court considers that it is not in the interest of the proper administration of justice that a person exercising functions of judge ad hoc in a case at the same time, or has recently exercised the functions of officer, Board or counsel in another case before the Court. As a result, when they designate a judge ad hoc pursuant to section 31 of the Statute and article 35 of the regulations of the Court, the parties should refrain from select persons exercising the functions of officer, Board or counsel in another case before the Court, or having exercised such functions in the three years prior to their appointment. In addition, parties should also refrain from appoint as agent, or advocate in a case before the Court a person exercising functions of ad hoc judge in another case before the Court.



Statement of procedure VIII.

The Court considers that it is not in the interest of the proper administration of justice that a person having been up to date recent member of the Court, judge ad hoc, Registrar, Deputy Registrar or senior officer of the Court (principal legal Secretary, first Secretary or Secretary) to intervene as officer, Board or counsel in a case before the Court. Accordingly, the parties should refrain from appoint as agent, or advocate in a case before the Court a person having been, in the three years prior to this appointment, Member of the Court, ad hoc judge, Registrar, Deputy Registrar or senior court official.



Statement of procedure IX

1. The parties to a case before the Court should refrain from presenting new documents after the close of the written procedure.



2. If a party wishes to nevertheless present a document new after the close of the written procedure, including during the oral procedure, under article 56, paragraphs 1 and 2, of the regulation, it will have to explain why it considers necessary to pay this document in the record of the case and why it has not been able to produce earlier.



3. Absence of consent of the other party, the Court will not allow the presentation of the new document only in exceptional, provided this document appears it necessary and its production warranted at this stage of the procedure.



4. If a new document contributed to the record of the case in accordance with the provisions of article 56 of the rules of court, the opposing party, commenting on it, shall present other documents only to the extent that they would be strictly necessary and relevant for the purposes of its comments on the content of the new document.



Statement of procedure IXA

1. There must not be made recourse to article 56, paragraph 4, of the regulations of the Court in a manner which violates the general rule that any document in support of the claims of a party should be attached to the parts of procedure or product under section 56, paragraphs 1 and 2, of the regulations of the Court.



2. The Court determines, in the context of a particular case, whether a document referred to in the title of article 56, paragraph 4, of the regulations of the Court can be regarded as "part of a readily available publication"; It wishes however to specify the parties that the following two conditions must be met so that this provision can be applied:



(i) first, the document must be "part of a publication" - in other words, it must be in the public domain. This publication can be in any format (printed or electronic), in any form (physical or online - on a Web page, for example) or on any medium (paper, digital medium or any other medium) data.



(ii) second, a publication is considered as "easily accessible" insofar as it is for the Court and the other party. Thus, the publication, or its relevant, must be accessible in one or other of the official languages of the Court, and it must be possible to consult within reasonably short. Therefore, a party wishing to mention during the oral procedure a new document from a publication that is not accessible in one or other of the official languages of the Court shall produce accurate certified translations of this document in any one of these languages.



3. To demonstrate that a document is part of a publication accessible pursuant to paragraph 2 above‑above, and for the purpose of ensuring the smooth running of the judicial procedure any party referring a document pursuant to article 56, paragraph 4, of the regulations of the Court must provide the necessary references to its quick reference, unless the origin of the publication is notorious (United Nations documents)(, collections of multilateral treaties, major monographs on international law, works of reference, for example).



4. If, during the oral procedure, a party objects to what either party mentions a document pursuant to article 56, paragraph 4, of the regulations of the Court, the Court decides.



5. If, during the oral procedure, part refers to a document that is part of a readily available publication, the possibility is available to the other party to comment on it.



B procedure IX training

The Court took note of the practice of the parties to establish, for the convenience of the judges, records of pleadings. The Court invites the parties to be able in this regard and recalls that documents in a folder of argument must have been produced pursuant to section 43, status or to article 56, paragraphs 1 and 2 of the regulations of the Court. Any other material cannot be placed on this record, unless part of a readily accessible published in accordance with the statement of IXA procedure and under the conditions laid down by‑above. In addition, the parties must specify in what annex parts of procedure or document produced under section 56, paragraphs 1 and 2, of the regulations the documents listed in the argument file originated.



Statement of procedure X

Whenever a decision on a question of procedure must be taken in a case and that the President deems it necessary to call agents to learn from the parties in this regard, in application of article 31 of the regulations of the Court, it is expected of officers that they meet with the President as soon as possible.



Proceedings XI training

In their oral submissions on applications for indication of provisional measures, the parties should be limited to issues relating to the conditions for the purposes of the indication of provisional measures, as they stand out the status, the regulations and the case law of the Court. The parties should not address the merits of the case to the‑beyond what is strictly necessary for the purposes of the application.

The provision of article 31 of the regulations of the Court to which the President information to the parties on matters of procedure is understanding thus:



After the first meeting with the President, the parties, when it is again called to inquire with them about procedural matters, may, if they agree on the procedure to follow, inform by letter.



The views of the parties on the further proceedings may also, if they are in agreement, be collected by teleconference.

Practical information

The Court has its headquarters in the Palace of peace at the Hague (Netherlands) since 1946. Its predecessor, the Permanent Court of International Justice, already occupied the premises made available to the Palace by the Carnegie Foundation, which is the owner and administrator since 1922.



Built from 1907 to 1913 for the Permanent Court of arbitration with a gift of Andrew Carnegie, industrial of original Scottish who made a fortune in the United States, the Peace Palace is located in a domain green of 7 hectares in the heart of the city.



The building, erected on the plans of the French architect Louis Cordonnier in a style eclectic, primarily Renaissance, is made of granite, sandstone and red brick imposing roof of grey slates. The facade, which extend lawns, is decorated with a series of characters referring to justice and peace. On the left, with its carillon clock tower rises up to 80 metres. Interior woodwork, stained glass, mosaics, tapestries and works of art offered by the States involved in the Hague peace conferences reflect the diversity of cultures.



In 1978, a new wing with the deliberation of the court room and the offices of its members was built at the rear of the Palace. This wing was expanded in 1997 in view, in particular, to welcome the increased number of ad hoc judges. The same year, the attic of the courthouse were built to install new offices for the officials of the registry.



The Palace which, in addition to the Permanent Court of arbitration and the International Court of Justice, also houses one of the largest libraries of public international law in the world (library of the Peace Palace, accessible to the public, which is not the case for the Court), and hosts summer of the Academy of international law in the Haguecan be visited on business days.



A museum on the history and activity of these institutions in the Peace Palace was inaugurated in May 1999 by Mr. Kofi Annan and Mr. Stephen M. Schwebel, respectively Secretary-General of the United Nations and President of the Court at the time. This museum is located in the South Wing of the building.

Le visage poupin et l’œil malicieux dans le box des prévenus, une jeune femme de 31 ans a comparu, décontractée, devant le tribunal correctionnel de Toulouse. Malgré ses 26 condamnations au casier judiciaire et plusieurs séjours à la maison d’arrêt de Seysses, la perspective d’une nouvelle sanction semblait l’indifférer tant qu’elle a éclaté de rire à plusieurs reprises au cours de l’audience.
Elle comparaissait pour avoir volé pour 1 200 € de victuailles dans un magasin de Beauzelle et reculé volontairement, en voiture, sur une employée du magasin. « Je n’ai pas voulu blesser cette femme. Moi quand je tue quelqu’un ça me rapporte. Pas pour 1 200 €», a-t-elle justifié avec maladresse. Son comportement n’a pas franchement surpris son avocat, Me Alexandre Parra-Bruguière : « Je savais qu’à l’audience, elle pourrait avoir une attitude qui peut choquer. Mais c’est une personne sympathique, quelqu’un de chaleureux qui ne se plaint pas malgré une vie difficile. » Au vu du casier judiciaire long comme le bras de la prévenue, le procureur avait requis deux ans de prison ferme. Elle a finalement écopé de sept mois de prison et a, de nouveau, éclaté de rire.

Lorsque cette femme sortira de prison qu’elle prenne contact avec l’Association SEFCA EUROPE, car nous avons besoin d’une personne comme elle.

Dans le langage quotidien, l'adjectif "contradictoire" est synonyme d'"illogique" ou encore d' "inconséquent". Dans le langage procédural, "contradictoire" qualifie le fait que dans le cours d'un procès, chacune des parties a été mise en mesure de discuter à la fois, l'énoncé des faits et les moyens juridiques que ses adversaires lui ont opposés. Il est question alors du " respect du contradictoire " et encore, en parlant d'un jugement, qu'il est intervenu " au contradictoire des parties "



"Le principe du respect du contradictoire", on dit aussi "principe du respect de la contradiction", s'applique à tous les états de la procédure. Il exige que le demandeur informe le défendeur de sa prétention, que les parties échangent leurs conclusions et leurs pièces, que les mesures propres à l'établissement de la preuve soient menées en présence des parties et de leurs conseils, que les débats soient eux mêmes contradictoirement menés, que le jugement soit rendu en audience publique à une date dont les parties ont été tenues informées par le juge lors de la clôture des débats. Relativement à l'application du principe du respect du contradictoire, la Cour de Cassation a rappelé (Cass. 2e civ., C., 26 juin 2003 ; SA Tréfimétaux, Arrêts n° 971, n° 972, n°973, . JCP G 2003, n°28 act. 358) le caractère impératif du « principe de la contradiction ». Elle a en cassé l'arrêt d'une cour d'appel ayant interdit à une société appelante, d'une part, de répliquer aux intimés du chef de leurs appels incidents respectifs et lui ayant interdit, d'autre part, de produire les pièces réclamées par la sommation de communiquer des intimés. L'arrêt de la Cour d'appel avait motivé cette interdiction en considérant que l'ordonnance du Premier président fixant l'affaire pour être plaidée, avait établi avec l'accord des parties, un échéancier de leurs conclusions, que cette ordonnance ne prévoyait pas de réponse. La Cour de cassation a retenu que les derniers écrits de l'appelante, accompagnés de pièces nouvelles, contenaient de nouveaux développements qui, formulés la veille de l'audience, n'avaient pas permis qu'il y soit répliqué. Voir aussi l'arrêt de la Première chambre (1ère Civ. - 13 novembre 2008 BICC n°698 du 15 mars 2009) cassant un arrêt d'une Cour d'appel qui avait fondé sa décision sur un moyen qui n'avait pas été soulevé par les parties et sur lequel la Cour d'appel ne les avait pas invités à conclure. Le respect du contradictoire a été aussi appliqué au cas où la cour d'appel avait rendu un arrêt visant des conclusions écrites du ministère public, intervenant en qualité de partie jointe, sans constater que l'une des parties avait eu communication de ces conclusions et des pièces jointes, ni qu'elle avait eu la possibilité d'y répondre. (1ère Civ. - 23 janvier 2008, BICC n°684 du 15 juin 2008). En revanche, dans une affaire dans laquelle de nombreuses parties avaient été appelées en cours de procédure, après qu'un rapport d'expertise ait été déposé, il a été jugé que ce rapport ayant été versé aux débats et soumis à la discussion contradictoire des parties, c'est sans méconnaître les dispositions de l'article 16 du code de procédure civile, que la cour d'appel s'est déterminée en considération de ce seul rapport (2ème Chambre civile 8 septembre 2011 pourvoi n°10-19919, BICC n°753 du 15 décembre 2011 et Legifrance). Mais faut il encore pour que l'exception soit jugée recevable, que la partie qui excipe de la non-communication de pièces n'ait pas eue une conduite procédurale fautive ne lui ayant pas permis de prendre connaissance des documents produits par son adversaire. Ainsi, dans une procédure orale suivie devant une juridiction de proximité, celui qui n'a pas comparu bien que régulièrement convoqué, ne peut se prévaloir utilement d'un défaut de communication de pièces dont le président a demandé à l'audience la production en cours de délibéré (2ème Chambre civile 20 octobre 2011, pourvoi n°10-17660, BICC n°756 du 15 février 2012 et Legifrance).



Concernant les opérations d'expertise, la seconde Chambre de la Cour de cassation a confirmé son arrêt du 1er mars 1989 (2e Civ., 1er mars 1989, Bull. 1989, II, n° 57) sur l'opposabilité des rapports d'expertise lorsque la partie à laquelle on l'oppose n'a été ni présente, ni représentée, ni appelée aux opérations de l'expert (2e Civ., 18 juin 1997, Bull. 1997, II, n° 195). Elle a jugé que l'expertise, même si elle avait été ordonnée dans une autre instance, pouvait être prise en considération dès lors qu'elle avait été régulièrement versée aux débats et soumise à la discussion contradictoire des parties. (2e Civ. - 17 avril 2008. - BICC n°687 du 15 septembre 2008). La troisième Chambre a jugé de son côté, qu'en se fondant exclusivement sur une expertise non contradictoire établie à la demande d'une des parties, la cour d'appel, avait méconnu le principe de l'égalité des armes, avait violé l'article 6 § 1 de la Convention de sauvegarde des droits de l'homme et des libertés fondamentales (3e chambre civile 3 février 2010, pourvoi n°09-10631, BICC n°725 du 1er juillet 2010 et Legifrance). Après que la décision du tribunal a été rendue publique, aucune mesure d'exécution ne peut intervenir avant que le jugement ou l'arrêt, selon le cas, ait été notifié et avant que celles des parties qui a été condamnée ait été mise en demeure par un commandement fait par huissier, lui intime un délai pour s'exécuter. Voir à ce sujet le Décret n° 2006-936 du 27 juillet 2006 relatif aux procédures de saisie immobilière et de distribution du prix d'un immeuble.



Certaines procédure n'ont cependant pas lieu au contradictoire des parties. Il en est ainsi d'abord dans le cas où le juge prend une mesure d'administration judiciaire, il s'agit alors d'une simple mesure d'ordre, telle que le renvoi à une autre audience, ou une décision de jonction, tel est aussi le cas des procédures qui ne peuvent faire grief aux parties. C'est aussi le cas des procédures rendues dans les matières gracieuses puisque par nature le demandeur n'a pas d'adversaire. C'est également le cas des procédures sur requête donnant lieu à des ordonnances faites "en cabinet".



Les procédures peuvent être simplifiées et donc plus rapides. Tel est le cas, par exemple, la procédure d'injonction de payer ou de faire et, en matière sociale, des contraintes émises par les organismes sociaux qui sont destinées au recouvrement des cotisations et des majorations dues pour cause de retard. La décision du juge ou la décision de l'organisme social, selon le cas, est prise hors du contradictoire des parties. Mais, après qu'elle ait fait l'objet d'une notification, la partie condamnée peut saisir le juge afin d'obtenir qu'il rapporte la décision prise hors de sa présence. Dans ce cas, la saisine du juge interrompt l'exécution de l'ordonnance ou de la contrainte, la cause est alors appelée en audience ordinaire pour que puisse s'instituer un débat contradictoire.



La règle procédurale concernant l'opposition au jugement pris par défaut, cherche à éviter qu'un défendeur ne se présente pas à l'audience dans la seule l'intention de faire durer la procédure en multipliant les voies de recours. Dans ce but, le Nouveau code de procédure civile n'admet la recevabilité de la procédure d'opposition, que dans le seul cas où, la notification n'a pu être faite à la personne même qui en est la destinataire. C'est le cas, lorsque en l'absence de cette dernière, l'huissier qui a la mission de notifier l'acte, n'a pu remettre l'acte d' assignation, qu'à un membre de la famille, à un voisin, ou au gardien de son immeuble. Le jugement est alors dit "rendu par défaut" et, dans ce cas, il est susceptible de faire l'objet d'une procédure d'opposition



En revanche, si ayant reçu personnellement l'assignation, le défendeur ne comparaît pas ou ne se fait pas représenter, le jugement qui est rendu est alors dit " réputé contradictoire". Dans la mesure où l'appel est recevable, il ne reste à la personne condamnée, que de saisir la juridiction du second degré. Et si le jugement a été rendu en dernier ressort, et si les motifs de son recours rendent son pourvoi recevable, de saisir la Cour de Cassation.



L'article 524 du nouveau Code de procédure civile permet aux Premiers Présidents de cours d'appel, statuant en référé, d'arrêter l'exécution provisoire de droit «en cas de violation manifeste du principe du contradictoire lorsque l'exécution risque d'entraîner des conséquences manifestement excessives. »(consulter : . Résumé de l'exposé

Le principe du contradictoire a d’abord été consacré par la jurisprudence, puis a été inscrite aux articles 14 et suivants du Nouveau code de procédure civile, formant la section IV intitulée la contradiction. Ce principe commande notamment la procédure civile, c’est-à-dire la procédure suivie, en matière civile, commerciale rurale et sociale devant les juridictions de l’ordre judiciaire. Tout jugement est le résultat d’une confrontation entre les plaideurs, lesquels doivent être en mesure de discuter et contredire les prétentions de leur adversaire ainsi que leurs preuves et leurs arguments. Cela implique la liberté pour chacune des parties à un procès, de faire connaître tout ce qui est nécessaire au succès de sa demande ou de sa défense. Toute démarche, toute présentation au juge d’une pièce ou d’une preuve par l’adversaire doit être portée à la connaissance de l’autre partie et librement discutée à l’audience. Le juge doit en toutes circonstances observer et faire observer le principe de la contradiction et ne peut retenir dans sa décision que les explications qu’il a recueillies contradictoirement. La contradiction permet donc de protéger aussi bien les intérêts de la défense que ceux du demandeur. La Cour européenne des droits de l’Homme en fait d’ailleurs le point central du droit à un procès équitable visé à l’article 6 paragraphe 1 de la Convention européenne des droits de l’Homme. Le Conseil d’Etat, quant à lui, l’a érigé en principe général du droit dans sa décision du 12 octobre 1979.

Mais par qui et comment le principe du contradictoire est-il respecté en procédure civile ?

L’exigence de contradiction affecte aussi bien les rapports des parties entre elles mais aussi leur relation avec le juge. Il convient donc de voir tout d’abord le principe du contradictoire à l’égard des parties (I), puis à l’égard du juge (II).





[...] Cette obligation résulte de l’article 15 du Nouveau code de procédure civile qui dispose que les parties doivent se faire connaître mutuellement en temps les moyens de fait sur lesquels elles fondent leurs prétentions, les éléments de preuve qu’elles produisent et les moyens de droit qu’elles invoquent, afin que chacune soit à même d’organiser sa défense Une communication tardive des pièces ne permettrait pas à l’adversaire de se préparer, c’est pourquoi elle doit se faire en temps utile. L’appréciation de ce caractère tardif est soumise à l’appréciation souveraine des juges du fond, comme le montre un arrêt de la chambre mixte de la Cour de cassation du 3 février 2006. [...]







[...] I Le principe du contradictoire à l’égard des parties Le principe du contradictoire suppose deux obligations de la part des parties. Elles doivent en effet être informées des audiences les concernant et communiquer leurs pièces en temps utile L’obligation d’information Lorsqu’une personne intente un procès, elle doit en informer le défendeur. Toutes -s fois qu’une audience doit être tenue, chacune des parties doit être appelée. Cependant, si une partie régulièrement appelée ne se présente et par ce fait n’est pas entendue, le jugement sera valablement rendu, selon l’article 14 du Nouveau code de procédure civile. [...]



Le respect du contradictoire par le juges : Pour l'application de l'article 16 alinéa 2 du CPC par les juges

L'article 12 du CPC précise que le juge doit trancher le litige conformément aux règles de droits applicables.

A ce titre, le juge n'est pas tenu par le fondement juridique avancé par les parties.

Il peut donc soulever, de sa propre initiative, un moyen de droit et l'opposer aux parties.

En soi, cela n'est en rien choquant, bien au contraire.

Ce qui devient en revanche difficilement acceptable, c'est lorsque le magistrat, dans son délibéré, soulève d'office un point de droit et statue sur ce point

sans inviter les parties à s'expliquer.

Cela peut arriver lorsque le débat est contradictoire mais peut arriver également lorsque le défendeur est défaillant.

Il arrive ainsi bien souvent que le magistrat déboute le demandeur en soulevant d'office un point de droit, qui en outre peut-être erronée.

Or, cela est en totale violation avec l'article 16 alinéa 2 du CPC qui dispose que le magistrat ne " peut fonder sa décision sur les moyens de droit qu'il a relevés d'office sans avoir au préalable invité les parties à présenter leurs observations ".

Le problème est qu'il n'existe aucun recours au juge ayant rendu la décision. Seule la voie de l'appel, ou du pourvoi en Cassation pour les décision rendues en dernier ressort, sont ouvert. Néanmoins, la longueur et le cout de ces procédures peuvent être décourageantes pour les justicables.

Rappelons donc aux juges qu'ils ne peuvent soulever d'office et débouter un demandeur, même et surtout en l'absence de défendeurs constitués, sans avoir recueilli les obersavtions du demandeur et ce afin de faire simplement respecter le principe du contradictoire. Les juges devraient donc réouvrir les débats systématiquepement, ce qu'ils ne font que très rarement. Est-ce un simple ouble de l'article 16 alinéa 2 ou une volonté délibéré afin de rendre un maximum de jugements et donc alléger le rôle du Tribunal dans un but purement de statistique.

In the 11th and 12th centuries settled for men the use, from Italy, to wear long dresses and women. It is to him that we say, in short, be traced the origin of the judicial costume.

Italy, Scarlet color fabrics, fur ermine and vair are laid exclusively by the nobility, as a sign of independence and sovereignty. The doge of Venice wears a scarlet robe, a cap of the same colour and ornate bands of ermine. In France also, the men in almost all conditions, bourgeois, noble, civil servants, magistrates, carried to the 14th century the long dress. Our dress therefore appears simply as the former civil costume, made immutable by the requirements of use.







The world was, therefore, distinguished between "short dress people" and "people of the long robe."







These included, judges and officers of the Court (lawyers, prosecutors, bailiffs), the doctors of the universities, mayors, aldermen consuls and other magistrates of the corporations, who retained also the costume and wearing at least in ceremonies.







The colors of these dresses ranged from to infinity. The Parliament of Paris is perhaps the only body which has is an exception; He was always dressed in red. Gaignière, in his valuable collection of portraits of the Kings, princes, Lords and people of various professions, which are the different clothing of each reign, tells us that in the XIV and XV centuries, the popular judiciaries dresses, in particular members of the Hôtel de Ville of Paris, were usually parties, i.e. of a color to the right and another left, but that had nothing fixed : part white and purple, white and green, green and vermilion, etc.







Dresses of the characters of the judiciary were distinguished from others and what they were gathered or tight at the waist by a belt. they most often included two layered dresses, the outerwear, called "ganache", very long, closed to the neck, sleeves in pilgrim way, sometimes lined with or, for Presidents, filled with ermine.







Finally, the magistrates of the sovereign courts, as well as the doctors of the faculties, was reserved the chaperone. He still retained the form of a Cap. The form of the mantle of the Presidents also had variants following parliaments. But it was a tradition that he was the same for all Presidents of a Parliament.

I note, with the rock-Flavin, the costume of the Presidents was, except the scepter and Crown, that were, in the major circumstances, our ancient kings. The hat round and flat, black velvet, passementé gold, known as the "mortar", and wore the first President and the Presidents "to mortar", was the former hairdresser of the Kings of France, given by them to, their more senior judges. Its form was not identical in all parliaments. In some, such as in Toulouse, the Presidents are covered; in others, it was so flat, other times so large that it could not put it at the top, which was also little inconvenience, the chaperone first, and then the CAP or later the wig is acting in turn.

The differences prevailing between the costumes of the Presidents following parliaments raised, in the 18th century, in the Parliament of Toulouse, a violent conflict which the memory was long perennial in this city, episode of the struggle of parliaments for their independence.







Complying with practices in force, of the new first President said Parliament, François de Bastard, had gone, in 1762, at Fontainebleau, before the King to be admitted to the oath, coated of common badges in its Parliament, mortar single stripe and without made of ermine mantle. Nevertheless, the magnificence of the costume of our former MPs gave their audiences, in particular to those of the Parliament of Paris, a solemnity that attracted many curious kings themselves agreed to attend. Former use was that foreign sovereigns and princes who came to Paris were conducted by the King in Parliament.







Rabelais, which turned much ridiculed what he calls "the Palatine world", did not breach nor send Pantagruel to visit those he named cats thickets. During the former regime, the royalty and the parliaments themselves, jealous of their prestige, ensured carefully to require judges to respect the dignity of their character into their dress. They attached a great price to what they called the "decency" in the costume, as well in life private in public life. In the 17th century, the recommendations of the judicial bodies and Royal edicts are becoming more urgent. because, at that time, abuse enter the customs of the judiciary, which was highly criticised in the opinion of the Kingdom. Is this edict that La Bruyère, severe as many of his contemporaries in the place of judges, alluded when he wrote: "It it not that religion and justice go hand in hand in the Republic and that the judiciary enshrined men as the priesthood;" dress man can hardly be dancing at the ball, released to theatres, waive the clothes simple and modest, without consent to his own degradation; "it is strange that it had taken a law (this is the edict of 1654) to adjust its outside and thus force him to be serious and most respected."







This regulation went not without resistance on the part of the judges, who were jealous of the freedom of their costumes. "They preferred, said Lavisse, in its history (t. VII, part 1, p. 298), the grey dress and tortillée tie; they went to the Palace, cane in hand. The galant magistrate that begins to appear, as begins the Abbot of court, considers less than his ancestor to the long coat and long beards. "It is less also."







The label issues sometimes raised serious difficulties on the part of lawyers, which attached importance which is now excessive and childish. Sometimes they claimed the right to the Parliament, during the solemn hearings, "to the good days", as said Loisel, the dress of scarlet, purple or red, submission to which they appear to have given up the XVIèmesiècle. The constituent Assembly, through justice on new bases, anxious to break with the past, hostile to the ancient judicial institutions, whose abuse called a necessary reform, wanted a judiciary also austere and simple as possible in her dress.

The Act of September 11, 1790, art. 10, attributed to the judges of the district office trïbunaux the black dress, a round hat by the front and topped with a plume of black feathers. As justices of the peace they were given no distinctive markings; but art. 12 of the Act of the 6-27 March 1791 entitled to wear, attached to the left side of the dress, a cloth, red border, blue, oval medallion on which were inscribed in white letters these words: the law and peace.

Subsequently, history teaches us that the work of the constituent Assembly, in particular the system of election of judges, had not produced good results. Citizens were not judges the consideration and respect due to justice. The hearings were not always conducted with the necessary dignity.







Also the Convention, who was known, the passion of external events, was concerned to raise the large part of the public functions by surrounding a certain brightness. She did a test, remained unsuccessful, amendment to the judicial badges.

The Committee of public instruction proposed for members of the Legislative Assembly a white breeches, a large blue dress on the chest and a scarlet coat.







"This is a costume too jacobin", opina MP Hardy. Another, it is true, said for his part: "this habit dates back to the time of François I", "so said Councillor les Sablons Tarbé, in his book"Laws and regulations for the use of the Court of Cassation"that it was not expected to see quote François Ier as an authority before the Convention.

The abbé Grégoire proposed a solution which ultimately prevailed: "forms of our clothes, said, are inartistes", if I may say so. It was decided, on these remarks, that members of the legislature and the Council of the elders wear a white long dress, a blue belt, a scarlet mantle, all in wool, and a toque of velvet white.







This costume was, let's him see, adopted, with some changes, especially in the color device, for the Court of cassation.







But the dress was not made to the judges of the other courts, in fear that it ressuscitât the apparatus requiring former parliaments.







As the legislature intended yet enhance the prestige outside the judiciary, very compromised at the time, he took measurements, which moreover were not made to produce the desired effect.







It left under the Executive Board to the civil courts, become courts Department, costume set by the constituent Assembly, but on imagina to award a distinctive sign: it was a look of silver, the eye of justice, worn on the chest, suspended by a white, edged Ribbon of blue and red.







The courts of commerce had costume or hallmark.







A metal olive branch, suspended on the chest by a Ribbon with the national colours is awarded to justices of the peace. During the hearing, Justice of the peace had to take a large stick white, topped by an Apple of ivory on which was painted also an eye, but black hand.







VII







The Consulate and the Empire, while again reorganizing the judiciary, considered that "to place, as said Treilhard, to the high priority that must be in the State, it was appropriate to reconnect with the past the chain of traditions and meet throughout trappings of his authority".







At the same time that were reconstituted the former body justice as courts of appeal, that the law society was reborn, the Supreme Court became the Court of cassation, the holding of the past was made to judges. It is an institution of the past that Napoleon however forgot to resurrect, security of tenure!







It was also not without some hesitation that it came back to the old costume.







An order of the 24 germinal year VIII (April 14, 1800) it was first bounded to prescribe that the magistrates and clerks of the courts of the Republic will be dressed in black. Everyone except clerks, had to wear a coat short black silk neck folded, with all around (but only for members of the appeal tribunals and criminal courts) of a blue sky, the width of the collar silk band. A batiste tie was hanging on the chest. The three horns Hat had the form tight by a Ribbon of silk or black velvet and the attached edges to the shape by loops similarly.







On this dark costume ruled the vivid colours of the ushers, who had to take a national blue cloth dress and a red panties.







Symbolic ribbons of the Executive Board, the ridiculous 1790 plumes were banned from the costume, which was still, by more than one side, criticism and jokes.







This is the famous order of the 2 nivôse year XI (23 December 1802), reconstituted judicial, back the dress.







The judges of the courts of appeal and criminals (judges and Government Commissioners) were granted:







Ordinary hearings, the simarre of black silk. the gown of Black wool with large sleeves; black silk to such fringe belt; the toque of black silk United; the decaying tie of white batiste folded; hair long or round; the Presidents and Vice-Presidents, a black velvet stripe edged at the toque; the solemn hearings and public ceremonies, red gown, lined with a black velvet toque and President of two stripes of gold.







The costume of the judges of the courts of first instance was the same, except that the solemn hearings and ceremonies, has no red dress, Black wool toque is topped by a stripe of money, and the belt is light blue silk.







Chief clerks wear the same costume as the judges, but the non-galonnée toque.







It was almost complete return to the costume of the former judiciary. The order of nivôse is today, except the few changes brought by the uses or ordered by the texts, our dress Charter.







VIII







We do not have until then, - and deliberately, - spoke in the costume of our forebears of the Tribunal and the Court of cassation. It was subject to a special treatment.







After the Act, 27 November - 1 December 1790 had created the Court of cassation, another of the 11-12 February 1791, set, in its article 4, the costume of its members, in a manner analogous to that, described above, given by the Act of 11 September 1790 to the judges of the district courts. Austere and undistinguished, this holding at least had the advantage of simplicity. You can see the specimen in the magnificent portrait of Hérault de Séchelle, Commissioner of the Government of the Court of cassation, on May 16, 1791, which adorns the Office of the President of our criminal division.







This costume should be worn long enough by the Tribunal. The Convention, it is true, in his essay of consolidation of the costumes, had assigned many unique dress inspired by the ancient, reproduced, in form, that we saw in the members of the Council of elders and the legislative body, but with otherwise distributed colors: dress long and light blue toque, white coat, red belt. Marie-Joseph Chénier was the Canadiens held, "better after all in the case of military uniform proposed by the Commission and which the streak would have judges resemble the pants of the Italian comedy" (sic).







Tarbé note this costume, except the provision of the national colours, included the simarre, the gown and the toque of former judges. Yet, it seems certain that it was never worn. No doubt, in these times of public misery, it was found too expensive. There he substituted., in practice, the black mantle.







Under the Consulate, the order of the 24 germinal year VIII fixing the costume of the members of the judiciary, attributed, in its article 2, the judges of the Court of cassation, as distinctive signs a band of purple silk which was to decorate the mantle of black silk around it, loops of gold attached to form the edges of the hat, a braid of gold with such a gland with the shape of the hat.







We first that the dress was definitively made, before being, as we saw, 2 nivôse year XI, to the other courts. Indeed, an order of the 20 vendémiaire an XI (October 12, 1802) settled and, at the same time as the costume of the great judge, Minister of Justice, the Court of cassation.

Born on 24 September 1868 in Bordeaux, he had remarkable studies in law.
